Who are we ?

A counting of the nationality of owners from
January 2017 gave the following result:

Owners Duties

Article 9 of the Law of Horizontal Property clearly sets out the obligations and duties of all owners. They are:

to respect general installations
to maintain his own flat to a good standard
to allow in his flat any repairs required for the building
to allow entry into his flat for a,b,and c.
to pay community fees
to contribute to the reserve fund which must be at least 5% of the operating budget
to observe care in the use of his property and in relations with other owners
to notify the Community where communications are to be sent
to notify any change of ownership

What do we own ?

Article 3 of the Law of Horizontal Property clearly sets out the terms of separate individual ownership of flats and the joint ownership of the common elements of the building.

“In the system of ownership set forth in Article 396 of the Civil Code, the owner of each flat or business premises shall have:

The unique and exclusive ownership rights over an adequately delimited area subject to independent usage, along with the architectural features and all types of installations, apparent or not, which may be included within its boundaries and which serve the owner exclusively, as well as any ancillary property expressly mentioned in the property deed, even when they are located outside the delimited area.
Co-ownership, with the other owners of flats and premises, of the remaining common areas, appurtenances and services.”
In paragraph a) the ‘ancillary property’ refers to garages and storage space contained in the basement of the building.
This is what we own within the Community of La Cala Hills Phase 1. But there is a bigger picture too – that of the Macrocommunity, where we share joint ownership of the common elements contained in this bigger community.

Our Neighbours

Our immediate Neighbours are La Cala Hills Phases 2 and 3. These are both run as separate and individual communities as are La Cala Hills Phases 4 and 5. There are also La Cala Hills villas and the community of Las Lomas.
